These Terms and Conditions (“Terms”) govern your use of the Shamal Digitals website at shamaldigitals.com (the “Site”) and the services provided by Shamal Digitals (“we,” “us,” or “our”). By accessing our Site or engaging our services, you (“Client” or “you”) agree to comply with and be bound by these Terms.
Shamal Digitals provides technology solutions, LED display rentals and sales, metal fabrication, 3D signage, and interior fit-out and maintenance services. All services are subject to the specific scope of work (SOW) agreed upon in writing between Shamal Digitals and the Client. Any work outside the agreed SOW will be treated as a variation and may be subject to additional charges and revised timelines.
All price estimates and quotations provided are valid for a limited period as stated in the project proposal, after which they may be subject to review.
Payment milestones, including any required advance deposits, intermediate project installments, and final balances upon completion, shall be outlined and agreed upon in the individual service contract or proposal for each project.
Overdue payments may incur administrative charges or result in the temporary suspension of ongoing services and deliverables until the account balance is fully settled.
While we strive to meet all agreed-upon deadlines, project timelines provided in quotations or SOWs are estimates. Shamal Digitals is not responsible for delays caused by third-party suppliers, force majeure events (including but not limited to natural disasters, government restrictions, or supply chain disruptions), or changes to the project scope requested by the Client after work has commenced.
All designs, custom graphics, engineering drawings, and software solutions created by Shamal Digitals in the course of a project remain the intellectual property of Shamal Digitals until full payment has been received.
Upon receipt of full payment, the Client is granted a non-exclusive license to use the final deliverables for their intended business purpose. This license does not transfer ownership of underlying design files, source files, or proprietary methods used to produce the deliverables unless explicitly agreed in writing.
The Client agrees to provide all necessary materials, information, approvals, and site access required for the timely completion of projects. The Client confirms and warrants that any content, images, logos, or branding materials provided to Shamal Digitals do not infringe upon the intellectual property rights of any third party, and agrees to indemnify Shamal Digitals against any claims arising from such materials.
We warrant our fabrication and installation services for a period of 12 months from the date of completion, covering defects in materials and workmanship under normal use.
This warranty does not cover damages resulting from misuse, accidents, unauthorized repairs or modifications, or environmental factors beyond our control (e.g. extreme weather, power surges, or force majeure events).
To the fullest extent permitted by law, Shamal Digitals shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of, or inability to use, our services or products — including but not limited to loss of profits, business interruption, or loss of data — even if we have been advised of the possibility of such damages. Our total liability under any project shall not exceed the total amount paid by the Client for that specific project.
These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Riyadh, Saudi Arabia.
We reserve the right to update these Terms at any time. Significant changes will be posted on this page along with a revised “Last updated” date. Continued use of our Site or services after changes are posted constitutes acceptance of the revised Terms.
